  1. How does a person proceeding pro se deal with the CPLR 2105 certification or is it waived for pro se appellants when they perfect an appeal?

    • In answer to your question submitted, a pro se (who is not an attorney) may not execute a 2105 since that is a certification by an attorney. Instead, the pro se must have an executed Stipulation pursuant to 5532 which states that the parties have stipulated to the contents of the Record.
