As the beginning of the appellate process, properly filing a Notice of Appeal is of paramount importance. Below are the necessary items one must include when filing a Notice of Appeal in the four departments of the New York State Appellate Division.
Remember that filing one’s Notice of Appeal is a jurisdictional requirement. Therefore, it is critical that it be done in a timely manner. One has 30 days from the date the Order is served with Notice of Entry (by hand) to file a Notice of Appeal. When served with Notice of Entry by mail, one has 35 days to file a Notice of Appeal.
