The New York State Appellate Division, Court of Appeals and the New Developments in E-Filing in the Appellate Division have many rules and regulations, some official, some less so, with which attorneys must comply when perfecting their appeals. In this CLE, we will begin by discussing E- Filing and how it’s changing how we file today with emphasis on the Appellate Division First and Second Departments. Following, we will explain the process and elaborate on the intricacies of that which is required when filing in any of these Courts. The presenters will continue by focusing on the preparation and timely filing of the Notice of Appeal and accompanying documents. Followed by enumerating the necessary documents to be included in the Record/Appendix and the requirements for the various appellate briefs. Idiosyncrasies such as enlargements of time, briefing schedules for appeals with numerous parties and filing Motions are also discussed in depth. The presenters discuss oral argument to conclude.
