AD1 and AD2 routinely dismiss appeals that have not been timely perfected. In both courts the clerks make calendars of all civil appeals not perfected in a timely manner and publish those calendars in the New York Law Journal. After these notices have been published for five days, AD1 will dismiss the appeal unless the appellant submits an affidavit explaining the delay. AD2 gives the appellant 10 days following the last date of publication to apply for an extension of time. If the appellant fails to do so the appeal will be dismissed.
